7.1.2 Compensatory Time Off

Policy Description

Monthly-Paid Staff (Exempt)
The employees of the exempt staff are responsible for extending their normal work schedules to fulfill the requirements of their positions when necessary. Compensatory time off, therefore, does not apply to the monthly staff (see 5.0.3 Flexible Work Schedules). 
Biweekly-Paid Staff (Non-exempt)
The Fair Labor Standards Act requires that nonexempt employees who work more than 40 hours in one defined workweek must be paid at a rate of not less than one and one-half times their hourly rate for the excess hours (see 7.1.1 Overtime).
However, if a nonexempt employee has performed hours of extra work and has worked less than 40 hours in the defined workweek, managers are permitted to assign time off in lieu of pay to compensate the employee in return for hours of extra work. The University has established the following rules for the application of compensatory time off for nonexempt employees:
  1. The time off allowed is on a one-for-one basis (one hour off for each excess hour worked).
  2. The compensatory time off must be assigned and used during the same defined workweek, i.e., Monday, 12:01 a.m. through Sunday, 12 a.m.)
As in the case with overtime, all nonexempt employees must receive prior supervisory approval for compensatory time off. Nonexempt employees who have worked 40 hours in the same defined workweek must be paid for time worked in excess of that schedule. Nonexempt employees and their supervisors should accurately record time worked in the Time Collection System to ensure proper payment for overtime and/or compensatory time.
Employees represented by a collective bargaining agreement should refer to the specific contract.
