Slovenia 1991

In l989, the Slovenian Assembly passed a constitutional amendment declaring Slovenia an independent state in the Socialist Federal Republics of Yugoslavia. The Slovene Christian Democratic Party passed another amendment in 1990, declaring full independence forming a new government on May 16, l990. The government announced a one-year timetable for the drafting and passage of a new constitution.

Following a constitutional process from the previous constitution, the government appointed a constitutional commission of experts headed by Miro Cerar, Professor of Law at Ljubliana University, to draft the initial language of the new constitution. During this period, the commission could observe neighboring, former Communist countries also declaring independence and drafting constitutions. The initial draft was sent directly to the Assembly for consideration without a period of public consultation.

The Assembly was elected by proportional representation with a threshold of 2.5% from the legislative councils. At the time of the deliberations, the 240 members of the Assembly represented a six-party coalition with three parties in opposition. The future electoral strength of the parties was uncertain. A 2/3 majority was required to pass the draft. The constitution was ratified on December 12, l991. Reorganization of the government was postponed until the new elections in 1992.
